The parent company of online retail operator, Digital Marketing and Solutions, along with its director, Yuen Ho Wong, are set to appear before a NSW Supreme Court after Fair Trading commenced injunction proceedings against the two.
Digital Marketing and Solutions trades online as Android Enjoyed and CameraSky, which have clocked up 604 (Android Enjoyed) and 178 (CameraSky) customer complaints to the industry watchdog.
The company and its sole director are based in Hong Kong, but operate an e-commerce retail business supplying goods to Australians such as mobile phones, cameras and accessories; and other electrical goods.
Customer complaints varied from failing to repair defective goods; failing to providing refunds for defective or damaged goods; and failing to supply goods within a reasonable time frame, or sometimes not at all, according to Fair Trading.
Complaints were also made about the quality of goods sold, the acceptance of payments without supplying the goods along with other Australian Consumer Law offences.
Android Enjoyed has appeared on the NSW Fair Trading Complaints Register 17 times since July 2016 with a total of 604 consumer complaints.
“It has been at the top of the Complaints Register on five separate occasions since September 2016,” Minister for Better Regulation, Matt Kean, said. “CameraSky has appeared on the Complaints Register six times with 178 complaints made by consumers. These are figures no company should be proud of.”
NSW Supreme Court proceedings will take place on 26 September.
Meanwhile, NSW Fair Trading publishes its Complaints Register every month, listing businesses that are the subject of 10 or more complaints to the agency in a single calendar month.
In September 2016, the company was put on notice by NSW Fair Trading, with the regulator warning consumers not to deal with the company and its online stores.
Fast forward to May 2018 and NSW Fair Trading Commissioner Rose Webb said that while the agency is investigating what further action can be taken against the online stores and their parent company, it is important consumers continue to report problems.
