Anyware recalls product due to TiVo legal challenge

TiVo Brands has issued a legal challenge, forcing the distributor to recall a newly released product.

Anyware has been forced to recall its Fiivo product following a legal challenge from TiVo Brands.

The distributor released the Fiivo PVR Multimedia Player, a device which offers similar functionality to the TiVo digital video recorder, earlier this month. The TiVo’s challenge was issued pertaining to the name in which the multimedia player is sold under. Anyware was asked to cease the product’s promotion as well.

Anyware marketing manager, Steve Grant, said while the situation was regrettable and an inconvenience, it would have minimal affect on the company.

“This is a very new product, so this action will have minor impact to our operations,” he said. “It would have been worse if it was to do with a product we launched more than six months ago.”

The distributor had proceeded in accordance to the legal challenge, Grant said. The Fiivo device will be re-branded, re-packaged and re-launched under a new name, which has yet to be decided on. The launch date is also uncertain.

Grant could not disclose the how much the recall would cost Anyware, and insisted the process would have little financial impact.

“We just started advertising the product and it is still very new to the Australian market, so there is not a massive cost involved,” he said.

The exclusive local licensee for TiVo, Hybrid Television Services, has said it was unaware of the situation and could not speak on behalf of TiVo Brands LLC.

What this article does not mention, is that the solicitors for Tivo also issued legal notices to all retailers who had stocked this item threatening legal action.

Anyware could have advised its resellers about this recall via its email marketing campaign as soon as they knew about this. Now we have more paperwork to do to response to Tivo's solicitors
