Federal Court orders interim injunctions on Allphones

The Federal Court has issued interim injunctions on Allphones,

The Federal Court has issued interim injunctions on mobile phone franchiser, Allphones, as the latter's battle with the ACCC continues.

The injunctions will restrain Allphones from giving or advertising preferential treatment with the supply of stock to franchisees who have signed any new agreements and/or a deed of release in its favour.

The ACCC first petitioned the Federal Court with interlocutory orders against Allphones in October of last year, claiming the company had breached the Franchising Code of Conduct.

According to the ACCC, Allphones had refused to allow franchisees to sell their businesses and also allegedly sent out a misleading position paper.

Allphones has also been ordered to pay the ACCC's costs.

The ACCC’s allegations have been disputed by Allphones and will be determined at a final hearing.
